R. Owen Williams, President of the Associated Colleges of the South, and Jim Newberry, an attorney focusing on higher education, will discuss a 2017 agreement that allows ACS members to obtain higher education legal services at competitive rates. The presenters will describe goals, elements, challenges and next steps. Among themes to be discussed are strategies to plan for and manage campus protests, regulations protecting sensitive data, and the balance between free speech and academic freedom.

Shared Legal Services: A Simple and Sensible Solution to Cost Containment

 

The Associated Colleges of the South and the law firm of Steptoe & Johnson PLLC reached an agreement in 2017 by which the 16 ACS members may obtain higher education legal services at competitive rates. By taking advantage of the members’ collective purchasing power, ACS member institutions are able to participate in compliance seminars, receive regular newsletters on higher education legal issues, and access emergency legal services, in addition to getting project-specific services as needed.

 

Services are divided into an educational component, that is, training and education programs designed to avoid problems, and a customized or project-specific component, based on legal issues that may arise.

The educational component includes quarterly Hot Topics training sessions in Atlanta or via webinar. Content is determined with input from participants but will generally consist of issues such as Title IX, FERPA, the Clery Act, the ADA and other compliance issues, and hot topics such as unionization efforts on campus or the impact of the new administration in Washington. Members receive monthly Higher Ed Legal Updates via email. Participants also receive 24/7/365 Emergency Management and Title IX Assistance – up to 4 hours per month of advice and counsel to address urgent situations on campus.

 

The project-specific component is that part of the plan where members have access to Steptoe Johnson attorneys on an as-needed basis. Participation in the plan is extra-cost and optional. The plan offers fee structures designed to provide cost-effective solutions when problems specific to the member's institution arise.

Jim Newberry an attorney with the national law firm Steptoe & Johnson in Virginia. His practice focuses on higher education, government relations, and regulatory matters. He is the former mayor of Lexington, Kentucky.

 

Owen Williams is President of the Associated Colleges of the South. He served as president of Transylvania University from 2010-2014, following a 24-year career as a Wall Street investment banker. In 1999, Dr. Williams left the business world to study at Yale University and Yale Law School, where he earned a doctorate in American History and a Master of Studies in Law.
